Mental Health Real Talk is a subsidiary of The Steven A. Gipson Hope for Tomorrow Foundation, Inc. and is a 501 (c)(3) nonprofit (also “Mental Health Real Talk”, “us”, “we”, or “our”) that runs forums, community spaces and supplies education around mental health through its websites mentalhealthrealtalk.com and stevenagipson.org (individually a “Service” or collectively the “Services”.) The rules that follow are really important and form part of the Terms and Conditions of Service (“Terms”). If you don’t agree with these rules or any other portion of the Terms, please don’t use the Service.

  • By using this website, or any Services provided on, from, or through this website, you agree to follow these Terms and our Privacy Policy.
  • Please understand, we are not mental health professionals and we do not offer mental health services. The opinions and advice offered on our site are given by non-professionals and offered only as solace and suggestions. Opinions expressed on this Site are not endorsed by us, and the user should always listen to a licensed mental healthcare professional. If you are experiencing a mental health crisis, thoughts of suicide or self-harm, please call 911 or contact your local mental healthcare professional immediately.
  • Our websites include community spaces and forums. You agree to be civil and respectful in all communications on our websites. We wholeheartedly believe we are our brother’s keeper, so please use discretion when responding to questions or posts, and report any activity that is suspicious or concerning. We reserve the right to determine, at our sole discretion, whether communications are harassing or disrespectful. We reserve the right to terminate your account for harassing or disrespectful posts or comments at our sole reasonable discretion.

We may, in our sole decision, change these Terms at any time without giving notice before we do so. From time to time, we will update these Terms. You will receive an automated update notification at the time of login. You understand you will be bound by changes we make to these terms as soon as they are posted. All links or guidelines referenced in these Terms are made a part of these Terms.

The Service, Donations, Accounts and Safety

Our Service allows users 13 or older to talk openly about mental healthcare challenges, create a profile, tributes, memorials, group talk, live chat, ask questions, and share advice in an accepting and caring space. Users can read stories about the mental health challenges of others or share their own stories. Click here to submit your story. Users can create a memorial or tribute about themselves or a loved one, click here. Users can also sign up to become an ACT Advocate, click here.

To access certain Services, you will need to open an account. Do not use an account that does not belong to you or is not registered in your name.

To encourage sharing, and foster community, we encourage all users to upload a picture and use their first and last name. You may choose a setting that allows your account to show publicly as “Members Only” or “Everyone”. When you share your story in our featured story section, you may choose to be “anonymous” when your story is published, this will help to protect your identity, however you must provide us accurate and complete information when setting up your account and profile. When you use the Live Chat-Group Talk Forum, you can choose an avatar from our database or upload your own photo. You will have to choose a username which will only be used during Live Chat-Group Talk Forum to protect your privacy. We reserve the right to delete incomplete accounts, or accounts with information that is inaccurate or cannot be validated. You are responsible for activity that occurs under your account. Treat all log-in information as confidential, and do not disclose it to any other person or entity. Your account is personal to you and you may not provide anyone else with access to this website, or its Services, using your user name, password or other security information. Notify us immediately if you discover a breach of security or an unauthorized use of your account.

We have the right to disable any user name, password or other identifier at any time in our sole discretion, including if, in our opinion, you violate these Terms. Where an identifier is disabled we are not liable for losses suffered, including but not limited to the loss of any data. If there is unauthorized use of your account, you may be liable for any damages or losses suffered by Mental Health Real Talk (defined below) as a result.

While using our website, you may not disclose personally identifying information, or confidential information, about someone other than yourself without their written consent. This includes names, geographical locations, diagnosis, medical conditions or similar items an individual might not want publically disclosed without knowing first. As you engage in our forums, use caution with disclosures and posts. Report and suspicious, offense or concerning behavior to us immediately at Contact Us.

Donations and Payment

  • Donations: Mental Health Real Talk is a 501(c)(3) nonprofit that relies on the generosity of its donors to offer resources such as its website. To support us on our mission of creating an online community where people with mental health challenges, you may donate to the organization on various pages within the Site.
  • Refunds: In compliance with state and federal law, once a donation is made, it may not be refunded. If you have questions about your donation, you may Contact Us.
  • Payment: Payment may be made through our Site by credit, debit card or PayPal. If you’re interested in other ways of giving (such as trusts or other testamentary instruments) please Contact Us.

We are not responsible for the content, privacy policies, or practices of any third party websites and you relieve Mental Health Real Talk from any and all liability arising from your use of a third-party website.

And you do not attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of this website, the server on which the website is stored, or any server, computer or database connected to the website.
  • You don’t engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our Services, or which, as determined by us, may harm us or users of our Services.

Submissions

You waive all rights to require or request royalties for submitted photo(s), submitted narratives, featured stories, memorials, and tributes. By submitting any photo(s) or written documents, you hereby grant Mental Health Real Talk a perpetual worldwide, royalty-free license to use submissions for the purposes of providing its Services to you and all other users, and permit Mental Health Real Talk to sublicense or transfer such rights to the extent necessary for its vendors or service providers to provide their services.

You may receive author credit for any submissions; however, we reserve the right to make professional editorial changes to the written material where we deem changes are necessary for posting (in order to decrease potential libel and liability) without making significant changes to the content. If you submit a story and it is chosen, we reserve the right to edit your story for accuracy and content. Prior to publishing your story, you will receive a copy of the edits and revisions of your story which will be sent to the email address that we have on fiIe. if you have questions about revisions to your story, please click on Contact Us. If we do not hear from you, your story will be published on the Site as edited.

If you submit a story, you agree you are either the person the story is about or personally know the person. The only exception is an individual, a group, or an entity that has conducted extensive research on the person that is the subject of their narration.

Written permission must be submitted along with a story if the submitter is not the person of the narration or the person that is the subject of the narration.

Submitter holds harmless Mental Health Real Talk for any negative effects the submitter may experience after publication of any submitted photo(s) or story(ies).

We maintain the right to choose which material (photo, life narrative, or podcast interview) to use or post. Your submitted story, memorial or tribute may not result in it being posted or appearing on the Site.

The donation amount to create tributes or memorials submitted may change at any time at the Site’s discretion.

Notwithstanding 6(g), the Site may advertise or promote events or specials where a certain number of users may create a tribute or a memorial without requiring a donation. Such events or specials will be limited in duration, subject to any additional terms and conditions and may be terminated at any time.

GROUP TALK-LIVE CHAT FORUM DISCLAIMERS & CODE OF CONDUCT

When entering the live chat forums users must agree to a separate set of terms and conditions. Notwithstanding, and without prejudice, to those you agree:

  • Our websites include community spaces and forums. You agree to be civil and respectful in all communications on our websites. Opinions expressed in a forum are not endorsed by us, and the user should always listen to a licensed mental healthcare professional. Your Content and Conduct

This website may contain message boards, profiles, forums, bulletin boards and other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display or transmit (hereinafter, "post") listings, messages, pictures, text, or content (collectively, "Content") on or through the website.

You are responsible for Content you post, along with the consequences of submitting and publishing Content. You represent and warrant (promise) you own all rights, consents, and permissions to post Content you submit; and if you don’t own these rights that you’ve obtained them from the legal owner.

You hereby give Mental Health Real Talk a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, modify, prepare derivative works of, display and perform your Content in connection with this website and/or SAG Hope for Tomorrow Foundation’s business. You also grant each user of the Service a non-exclusive license to access your Content. 

To be clear, the license you’ve agreed to above does not transfer ownership. It allows us to do things like highlight your listing on our homepage, promote the website and its Services, repurpose part or all of a Service in other media formats and otherwise carry out business in a way that allows users to benefit from being a part of our site. However, you may revoke the rights granted above at any time in a writing sent to us at contact@mentalhealthrealtalk.com and/or by deleting your account. Do keep in mind, though your Content may be removed from our Services we can’t guarantee Content will be removed from the Internet.

By connecting a Service with a third-party service, like a social media service, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials from that service.

If you post or send Content, you agree:

  • is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable, promotes sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, infringes any patent, trademark, trade secret, copyright or other intellectual property or other rights of any other person, violates the legal rights of others, contains material that could give rise to any civil or criminal liability or that otherwise conflicts with these Terms or our Privacy Policy, violates applicable local, national, or international laws and regulations, is likely to deceive any person, promotes any illegal activity, or advocates, promotes or assists in any unlawful act, causes annoyance, inconvenience or needless anxiety or likely to upset, embarrass, alarm or annoy any other person, impersonates any person, or misrepresents your identity or affiliation with any person or organization, involves (or includes a link to) commercial activities or sales, such as contests, sweepstakes or other sales promotions, barter or advertising, or gives the impression that it comes from or is endorsed by us or any other person or entity, if this is not the case.

We may disclose information about you to a third party who claims Content you post violates their rights, including intellectual property rights or privacy rights. We may also take legal action, including without limitation referring you to law enforcement, for any illegal or unauthorized use of the website. You understand we will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through our Services.

Your Interaction with Content

As you encounter Content you agree:

  • Content is provided to you AS IS and your use of Content is at your sole risk and expense. SAG Group is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content.
  • Not to circumvent, disable or otherwise interfere with security-related features of a Service, including features that restrict use or copying of Content or enforce limitations on use of a Service or its Content.
  • We do our best to monitor user accounts, however you may be exposed to Content that is inaccurate, offensive, indecent, or objectionable. Where this happens, report such activity to us immediately at Contact Us. Our contact information also appears at the end of these Terms. Because we can’t possibly monitor every account at all times, you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against SAG Group with respect to such contact.

We reserve all rights not expressly granted in or to a Service and its Content.

Termination of Use or of an Account

Please note, these terms do not give users a continued right to use or have access to the website. We want everyone to enjoy their experience, and consequently we reserve the right to terminate a user’s access, including a user’s account, if the user: (1) engages in predatory, bullying or unlawful behavior, (2) violates these Terms, (3) infringes on the intellectual property rights of others, or (4) infringes on the privacy rights of others. This includes the ability to remove a post that we believe is in violation of these Terms. Once your account is deleted, you will no longer have access to our features (such as the forums) requiring an account or to any data and files associated with your account.

If notified, as outlined in this Section, that Content infringes on another's intellectual property rights we reserve the right to remove such Content without prior notice and without liability.

Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by us without restriction. Any attempt by you to assign that is not consented to will be considered null and void.

Mental Health Real Talk and/or Steven A. Gipson Hope For Tomorrow and all related names, logos, service names, designs and slogans are trademarks of Mental Health Real Talk or its affiliates or licensors. You may not use these marks without our written permission. All other names, logos, service names, designs and slogans on this website are the trademarks of their respective owners. This website and its features, functionality (Content, trademarks, service marks and logos) are owned by, or if not owned licensed to, Mental Health Real Talk and are subject to copyright, trademark, patent, trade-secret and other intellectual property or proprietary rights under the law. General

You agree: These Terms are governed by the laws of the State of Georgia, without respect to its conflict of laws principles. Any claim or dispute between you and us that arises (in whole or in part) from use of a Service will be decided exclusively by a court of competent jurisdiction located in Georgia and you hereby waive the ability to assert otherwise. These Terms, together with the Privacy Policy and any sites or guidelines referenced here, or other legal notices published by Mental Health Real Talk on a Service, constitute the entire agreement between you and Mental Health Real Talk concerning a Service. If any provision in these Terms is deemed invalid by a court of competent jurisdiction, its invalidity will not affect the validity of the remaining provisions, which remain in full force and effect. No waiver by Mental Health Real Talk of any term or condition set forth in these Terms shall be considered a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Mental Health Real Talk to assert a right or provision under these Terms does not constitute a waiver of such right or provision that precludes us from enforcing at a later date.
